1Acceptance of Terms
In order to access or use the Service, you are required to affirmatively accept these Terms by selecting a designated checkbox presented during the account registration process, and such acceptance shall be deemed valid, binding, and enforceable to the fullest extent permitted by applicable law. A hyperlink providing access to the complete Terms shall be made available at the point of acceptance, and it shall be your sole responsibility to review the same in its entirety prior to providing your consent. The Company shall maintain a record of your acceptance, including timestamps and associated metadata, which shall serve as conclusive evidence of your agreement. Continued use of the Service following any updates or modifications to these Terms shall constitute your ongoing acceptance of such revised Terms.
2Description of the Service
The Service is a technology platform that enables users to input product URLs, following which the system retrieves and processes publicly available information from such URLs and utilizes third-party artificial intelligence systems to generate marketing assets, including but not limited to images and video advertisements. The Service operates as an intermediary layer and does not itself perform the underlying artificial intelligence generation but instead facilitates access to and interaction with external AI service providers. The Company offers both a limited free tier, which permits a restricted number of outputs, and paid plans that operate on a credit-based system, the terms of which are determined solely at the Company’s discretion.
3Third-Party Dependencies and Limitations
You expressly acknowledge and agree that the functionality, performance, and availability of the Service are inherently dependent on third-party systems, including but not limited to artificial intelligence providers, data processing services, hosting infrastructure, and other external technologies, all of which are beyond the Company’s direct control. The Company makes no representations or warranties of any kind regarding the reliability, consistency, availability, or performance of such third-party services, and any interruptions, inaccuracies, delays, failures, or inconsistencies arising therefrom shall not give rise to any liability or obligation on the part of the Company. You further acknowledge that such third-party services may change, degrade, or cease operation at any time without notice, and the Company shall not be responsible for any resulting impact on the Service.
4No Warranty and Output Disclaimer
All outputs generated through the Service, including but not limited to images, videos, or any derivative content, are provided strictly on an “as is” and “as available” basis without any guarantees, assurances, or warranties of any kind, whether express, implied, statutory, or otherwise. The Company expressly disclaims all warranties, including but not limited to warranties of accuracy, reliability, completeness, quality, fitness for a particular purpose, merchantability, or non-infringement. You acknowledge that outputs generated through artificial intelligence systems are inherently unpredictable and may contain errors, inaccuracies, biases, or content that is unsuitable for your intended purpose, and you agree that you shall bear full responsibility for evaluating and validating such outputs prior to any use. Under no circumstances shall dissatisfaction with generated content give rise to any claim, refund, or liability.
5User Responsibility for Content and Use
You agree that you are solely and exclusively responsible for all decisions relating to the use, distribution, publication, modification, or commercialization of any content generated through the Service. The Company does not monitor, control, or assume responsibility for how such content is used, and shall not be liable for any consequences arising from such use, including but not limited to reputational harm, regulatory violations, legal disputes, or public controversy. This includes, without limitation, any content that may be deemed offensive, misleading, inappropriate, defamatory, or otherwise objectionable. You further agree that any reliance on generated content is undertaken entirely at your own risk.
6Intellectual Property and Copyright Disclaimer
The Company makes no representations or warranties regarding the ownership, originality, or intellectual property status of any content generated through the Service. You acknowledge that such content may incorporate or resemble existing materials and may give rise to potential claims of copyright infringement, trademark violations, or other intellectual property disputes. The Company expressly disclaims all responsibility and liability in connection with any such claims, and you agree that you shall be solely responsible for conducting any necessary due diligence and obtaining any required rights, licenses, or permissions prior to using the generated content in any commercial or public context.
7Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of, or inability to use, the Service, including but not limited to loss of profits, loss of data, loss of business opportunities, or reputational damage, even if the Company has been advised of the possibility of such damages. In all cases, the total aggregate liability of the Company shall not exceed the lesser of the amount paid by you to the Company in the thirty (30) days preceding the event giving rise to the claim or INR 1,000. In cases where the Service has been used without payment under a free tier, the Company shall have no liability whatsoever.
8Payments, Credits, and Billing
The Service operates on a credit-based system. Credits are purchased either as part of a subscription plan or as a one-time credit pack, and are consumed as generations are performed. Credits that have been consumed by a completed generation cannot be restored or transferred. Where a generation fails for a technical reason attributable to the Service or its upstream providers, the credits consumed by that generation are restored to your account. Subscription plans renew automatically at the end of each billing cycle at the then-current price until cancelled by you. Prices are displayed at checkout before payment is taken. For transactions billed in Indian Rupees, Goods and Services Tax (GST) at the applicable statutory rate is charged in addition to the displayed price and is itemised on your invoice. Refunds, cancellations, and the process and timelines for requesting them are governed by our Refund & Cancellation Policy, which forms part of these Terms. Nothing in these Terms limits any right you may have to raise a dispute or chargeback with your bank or card issuer.
9Account Suspension and Termination
The Company may suspend, restrict, or terminate your account and access to the Service where you have breached these Terms, where misuse or fraudulent activity is suspected, or where required by law or by a payment processor or other service provider. Where an account is terminated for such cause, you shall not be entitled to a refund of amounts already paid or of credits already purchased. Where the Company discontinues the Service or terminates your account for its own operational convenience and not for cause, you may request a refund of the unused portion of your current subscription cycle and of any unconsumed credits, in accordance with the Refund & Cancellation Policy. You may close your own account at any time from your account settings.
10Prohibited Uses
You agree not to use the Service for any unlawful, harmful, deceptive, or otherwise objectionable purposes, including but not limited to the generation of content that violates applicable laws, infringes third-party rights, or promotes harmful or exploitative activities. The Company reserves the right to investigate and take appropriate action in response to any suspected violations, including account termination.
11Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including legal fees, arising out of or in connection with your use of the Service, your use of generated content, or your violation of these Terms.
12Data Processing and Third-Party Transmission
By using the Service, you expressly consent to the transmission, processing, and storage of your inputs, including URLs and associated data, by third-party service providers for the purpose of generating outputs. You acknowledge that such processing may occur outside of your jurisdiction and that the Company shall not be responsible for the practices or security measures of such third parties.
13Disclaimers and Service Availability
The Service is provided without any guarantee of continuous availability, uninterrupted access, or error-free operation. The Company disclaims all responsibility for downtime, interruptions, or technical failures, regardless of cause.
14Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, and any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
